General Terms and Conditions

 

1. Definitions

In these General Terms and Conditions:

  • The Art Beat Club: the tradename of Marenthe Otten, gevestigd aan Oude Molstraat 32D, 2513 BB The Hague, the Netherlands, registered with the Dutch Chamber of Commerce under number 27359182, VAT number NL001890474B92.

  • Student: any natural person who purchases a course, training, program, or Membership.

  • Agreement: any agreement between The Art Beat Club and the Student.

2. Applicability

These General Terms and Conditions apply to all Agreements between The Art Beat Club and the Student.

By purchasing any course, training, program, or Membership, the Student confirms to have read and accepted these Terms.

Any general terms and conditions of the Student are explicitly rejected and shall not apply.

3. Formation of the Agreement

An Agreement is concluded at the moment the Student completes a purchase via theartbeatclub.com and The Art Beat Club confirms the order.

Each renewal of a Membership constitutes a new Agreement.

4. Prices and Payment

All prices are stated in euros (€) and include VAT (21%), unless stated otherwise.

If an automatic payment fails, The Art Beat Club will make a second attempt within 7 days or issue an invoice with a specified due date.

If payment is not received after repeated attempts, The Art Beat Club reserves the right to:

  • suspend access to the course or Membership

  • terminate the Agreement

  • take further legal steps to collect outstanding fees

5. Right of Withdrawal (Cooling-Off Period)

The statutory right of withdrawal applies only to Students who qualify as consumers under applicable consumer protection laws.

If the Student qualifies as a consumer under applicable law, the Student has the right to withdraw from the Agreement within 14 days after purchase without giving any reason.

A withdrawal request may be submitted through:
• the withdrawal link included in the order confirmation email
• the withdrawal form available on the website
• email to hallo@marenthe.nl
• or the cancellation button, permanently available at theartbeatclub.com/customer-service (English) or theartbeatclub.com/klantenservice (Dutch), throughout the entire withdrawal period, without requiring an account.

Upon receipt of a withdrawal request, The Art Beat Club will process the request in accordance with applicable consumer protection laws.

Exception for Digital Content

For certain digital products, courses, programs and Memberships, The Art Beat Club may offer immediate access to digital content after purchase.

Where the checkout process includes an explicit consent mechanism through which the Student:

  • requests immediate access to the digital content; and

  • acknowledges that the statutory right of withdrawal will expire upon commencement of delivery,

the right of withdrawal shall expire once access to the digital content has been granted.

The checkout page will clearly indicate when this exception applies.

The Student's consent and acknowledgement will be recorded and stored as part of the order record.

6. Refunds and Withdrawal

Where a valid right of withdrawal exists under applicable consumer law, refunds will be processed after verification of the withdrawal request.

Where the Student has explicitly requested immediate access to digital content and acknowledged the loss of the statutory right of withdrawal during checkout, no refund shall be due after access has been granted.

Where the Student validly withdraws within the cooling-off period and the digital content exception above does not apply, The Art Beat Club will refund the full purchase price within 14 days, even if delivery of services (such as a live session or community access) has already started during that period.

Outside the cooling-off period described in Article 5, and except where required by law, purchases of digital products, online courses, programs, Memberships and other digital content are non-refundable.

7. Access and Use

Upon full payment, the Student receives a personal, non-transferable, non-exclusive license to access and use the materials.

The Student is strictly prohibited from:

  • sharing login details

  • copying, reproducing, or distributing materials

  • reselling or sublicensing content

8. Intellectual Property

All intellectual property rights remain exclusively with The Art Beat Club. No part of the content may be used for commercial purposes without prior written consent.

9. Community Guidelines

The Art Beat Club may offer access to community spaces.

By participating, the Student agrees to follow the engagement rules set within the community.

The Art Beat Club reserves the right to:

  • remove posts

  • restrict access

  • remove participants

This does not entitle the Student to any refund.

10. Performance of the Agreement

The Art Beat Club will perform the Agreement to the best of its ability (best efforts obligation).

The Art Beat Club provides educational and inspirational content. Results may vary depending on the Student’s effort, engagement, and personal circumstances.

No guarantees are given regarding specific outcomes or results.

11. Termination

The Art Beat Club may terminate or suspend the Agreement if the Student:

  • fails to meet payment obligations

  • violates these Terms

  • behaves in a way that disrupts the program or community

In such cases, no refund will be issued.

12. Liability

The Art Beat Club is not liable for:

  • indirect or consequential damages

  • loss of income or results

  • technical issues beyond its control

Liability, if any, is limited to the amount paid by the Student.

All liability is limited to the extent permitted by applicable law.

13. Privacy & Data Protection

The Art Beat Club processes personal data in accordance with the General Data Protection Regulation (GDPR).

Data collected may include:

  • name

  • email address

  • payment details

This data is used solely for the performance of the Agreement.

Processors used include:

  • Squarespace

  • Kit

  • Membirds

  • Plug & Pay

Data will not be shared with third parties unless required by law or necessary for service delivery.

14. Lifetime Access

Where “lifetime access” is offered, this means access for the lifetime of the course or platform, as long as The Art Beat Club remains operational.

Access may end or be modified in cases including:

  • business closure, sale, or restructuring

  • illness, incapacity, or death of the owner

  • technological limitations or failures

  • legal or regulatory changes

  • third-party platform issues

15. Complaints

Complaints must be submitted in writing to hallo@marenthe.nl within 7 days after the issue arises.

Submitting a complaint does not suspend payment obligations.

Complaints do not entitle the Student to refunds, discounts, or compensation.

16. Applicable Law

All Agreements are governed by Dutch law.

Any disputes shall be submitted to the competent court in The Hague, unless mandatory law provides otherwise.
